Board of Selectmen Minutes -- 11/22/2011
Present:        Beatrice Davis, Chairman; Jerry Dougherty IV and John Allen, Selectmen

  • Dickie Variance #2011-06/V01-44 Selectmen discussed concerns regarding the  Jackson Zoning Board of Adjustment’s arguments in reaching a decision to grant a variance was based on the premise pursuant to Section 2.2.3 of the Jackson Ordinance  that volume increase is permitted when the change is dictated by safety considerations, snow disposal or building code requirements while not increasing interior livable space, when in fact, by raising the roof line will increase interior floor space which is not required by current State Building Codes for existing non-conforming buildings; and further, it is possible to provide a safe 2nd means of egress from the building to the ground without making the building more non-conforming into the prescribed setback.    
     The Board sited substantial errors with unverified statements of background and fact
     presented by the applicant coupled with hardship standards not being met. Selectmen were
     unanimous in requesting a re-hearing for a variance request.  

     Selectmen Dougherty motioned the Jackson Selectmen does hereby request a re-hearing
     in the case of the re-application of a variance by Kevin and Patricia Dickie, no. 2011-06  
     and to submit a letter to that effect pursuant to RSA 677:2, Selectmen Allen seconded and
     all were in favor.
    


The meeting was adjourned at 5:50 p.m.
